An Article 4 direction removes permitted development rights for HMO conversion in part or all of Wigan. Converting a family home (C3) to a small HMO (C4) needs planning permission inside the direction area. Large HMOs of 7+ occupants are sui generis and always need permission.

On 15th July 2025 Wigan Council made a Borough Wide Non-Immediate Article 4 (1) Direction that removes permitted development rights for changes of use from individual dwellinghouses to small houses in multiple occupation (HMOs). A consultation period where the Council welcomed representations was held between the dates 22nd July until the 12th August 2025. The Council has now considered these representations and confirmed the Article 4(1) Direction on Thursday 21st August 2025. As such the Article 4(1) Direction will come into force on 31st August 2025.
